An Ekiti State High Court, Ado Ekiti division has sentenced two persons, Benjamin Joseph (32), and Stephen Orban (25), to death by hanging for robbing two persons of cash and valuable items.

The convicts were arraigned on December 30, 2022, on a four-count charge bordering on conspiracy and armed robbery.

The charge read, “On 16th August 2022 along Iluomoba Road, Aisegba Ekiti did conspire to commit a felony, to wit; armed robbery.

“As at the time of the robbery, they were armed with locally made guns, knives, and cutlasses and did rob Daramola Christiana and Ajayi Alaba of their belongings such as phones, power bank, creams, drugs, ATM Cards, and N105,000 cash among others.
“The offences are contrary to Sections 6(b) and 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. RII, Laws of the Federation of Nigeria, 2004,” the charge stated.

In her testimony before the court, one of the victims, a trader, said that four armed men attacked them at a barricaded point at Aisegba Ekiti along Omuo – Ado Ekiti Road.

The victim said, “They collected our phones, power bank, other valuables, and a cash sum of N105,000.00 and ran into the bush. I was rescued by a sympathizer, but the driver drove back to Omuo and made a formal complaint to the police”.

The prosecutor, Ibironke Odetola, called six witnesses and tendered charms, phones, camouflage underwear, a hammer, three hoods, fake Dollar notes, and cutlasses among others as exhibits, while the defendants spoke in their defence through their lawyer, Adeyinka Opaleke, and called no witnesses.

In the judgment on Thursday, Justice Blessing Ajileye, who said the prosecution proved the case beyond reasonable doubt that there was an armed robbery on 16th August 2022, found the two persons guilty.

The judge pronounced, “Consequently, the sentence of this court upon Benjamin Joseph and Stephen Orban is that they are hanged by the neck until they are dead, may God have mercy on your souls”.

Capital punishment for lesser crimes, pardon for bigger crimes. That is Nigeria for you.

No crime is justifiable. I am not defending these thieves. But do these boys deserve to be killed? If Boko members can be rehabilitated and tagged repentant, why not rehabilitate these boys?

But if you think these boys deserve death, why can't governors, senators and apprehended Boko members that commit grievious crimes be treated this same way?

What they did isn't a "lesser crime". Only those who do not understand the law push narratives like this.

There is a world of difference between robbery and armed robbery. If they had stolen without carrying a gun, snatched the items of initimadated, they won't be getting this punishment.

Once you cross that line and arm yourself before going to rob, you have entered a new world where your life is Forfeit

As for the politicians who you think commit bigger crime, financial crimes are not on the same level as armed robbery in the eye of the law. This is why Yahoo boys get 3-year sentences

do you know what they call karma? Do you know if those criminals have murdered their victims in the past? We have heard a lot about people being shot and killed by criminals like this over phone.

I do wonder why Nigeria still uses the old "Hang by your neck until your legs quit kicking" method which is the Short drop method where the victim suffocates until death over the standard drop where the rope breaks the neck and death is instant

Huh? Capital punishment for armed robbery?

Strange, but it is what it is.

They were armed and might have killed (if they haven't done that before) their victims if they tried to resist. The governor might not sign it sha but if he does, it'd be a lesson to those planning to do so tomorrow.

Let our judiciary try to mete out serious punishments as this to bigger pen thieves, looters, kidnappers and fraudster too.

What about the bandits that are rather taken to correction centers and declared repentant few months later? They carried arms as well and openly killed…
In my opinion, the sentence seems too extreme

The judgement is too harsh, since it did involve the death of the victims. The woman judge should be trained on judgment of leniency.

Judgement not bad at all. But if they put same judge to pronounce judgement on a government official or politician who enrich himself with hundreds of billions of naira from the public treasury, what he will deliver is 2 to 5 years with option of just a hundred thousand naira to some million naira fine
