You can be served a 6-month notice the day after you move in and the rest of your rent prorated and refunded.


You have said exactly what I said, I don't know why say I am not correct.
The moment the payment of a new tenant is refunded and he is given 6 months notice it means his rent is not running, that fulfills the law that you cannot give a tenant notice based on his valid rentage. That is 419, you collected the man's money and asked him to be looking for another apartment with which money,?

The law says he must enjoy the money paid in peace without harassment otherwise you refund his rent.

The lawyer called me today requesting a meeting. He said though they want to renovate the house they were not ready to evict anyone.
We're looking at alternatives of where to put items and other things during renovations.

Rent is crazy , reason I'm very sceptical
By the time you put together agency and agreement and commission and al those nonsense money we'd be looking at millions for a mini flat

Reason I'm just being worried..
Anything can still happen as long as that Notice to Quit was not withdrawn from the court.

Do not feel too relaxed. If I were you, I will still keep looking for another accommodation.

Seems states have different mode of operations. The lawyer we used to evict some tenants in Abia state had a stamp of the high court on it.

@OP Just start looking for money to move.
How many landlords would eject a tenant from an apartment at the end of a rental period to renovate the apartment and still readmit the same tenant to the same apartment? Almost none.

The notice to quit is in accordance with the Tenancy Law of Lagos State

Plead for more time , say maybe till February 2024, and prepare to move away

The law is that the landlord MUST not give you the required 6 or 3 months' notice as the case may be if he has a good lawyer. He can wait until your rent expires then serve you with a 7-day notice to quit. He can also serve you with a letter asking you not to renew rent at the expiration of your current tenancy. Technically, it's not a quit notice but you and I know that it's a quit notice. The law is that a landlord can evict a tenant when he denies the landlord's title to the property, for renovations or personal use. With regards to renovations, the provision is that he should put the tenant back after renovations therefore lawyers tend to just say that the reason for the eviction is to put the property for personal use.
Take note that you are to pay your rent even if you overstay for 1 day. I know this because I am a lawyer and I advise you to just move once your landlord gives you a notice to quit.

In fact to the last Kobo. Plus cost of litigation which includes all appearance fees paid and professional fees. If your landlord doesn't want you, just move. A lawyer can only buy time for you. Remember I said "buy time" because you will pay your lawyer and pay your landlord's lawyer.

You can use the remaining time to look for another apartment or try to appeal to the landlord of the apartment to see if he can have a change of heart.
if he didn't serve you rightfully you can deny you receive it .

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

You really needed to write your own law books. Those are misconceptions most laymen have and from my 16 years as a lawyer I can tell you most persons are as unaware as you are that that is wrong.

Notice to Quit is ideally given to expire on the same day as your rent expires. It is called "the anniversary of the tenancy".

The idea that you cannot be given a notice to quit while your rent runs is not only wrong but suggests you think, like some also do, that there is this free rent period a tenant is entitled to as he is given a quit notice. No, there is none.


In fact, even if you overstay by one day without the agreement of the landlord he can recover through the court rent for those days you overstayed. It is called "mesne profit" or "use and occupation" in law. Check it up.

The notice can START at anytime, the only thing is that it must END on the same day rent expires or after that but never before that day.

see you, when there is mesne profit, you can never escape payment even if the case lasts for 5 years, you are only delaying the payment but you must pay

It's not that I don't want move but the notice seems too sudden even though it's in 6 months time.

Start looking for another house. I pray God provide for you. Don't listen to those advising you to drag the matter to court. It won't well considering the fact that the quit notice given to you is legal....what I can advise you to do is just to beg for little time after November if you never see another house then. Shalom!

This is the only correct statement I have read so far. The notice period of 6 months should start after the expiration of the existing rent contract... So get a lawyer to respond to your landlord's lawyer...Simple.
